RESIDENTIAL LETTINGS & PROPERTY MANAGEMENT

TERMS & CONDITIONS

1.  A reference fee of £95.00 will be taken for all incoming tenants over the age of 18. This will also act as a holding deposit until the reference process is complete and/or failed.

2. Once you have been provisionally accepted by the landlord/landlady (subject to references and contract) the referencing fee of £95 becomes non-refundable unless the landlord withdraws the property due to their own unforeseen circumstances. If you choose to withdraw after acceptance or undeclared adverse information is uncovered during referencing, then you will forfeit all fees (plus a reasonable proportion of the Deposit, if taken, which reflects the landlord’s lost rent for the period between provisional acceptance and the date of rejection).

3. All applicants must provide photographic ID in the form of a passport/driving licence upon passing through the referencing process.

4. All applicants must provide proof of address in the form of a utility bill or bank statement.

5. All applicants must be over the age of 18 years.

6. The referencing company may ask for further supporting documents i.e. wage slips, bank statements, tax documentation etc. If self-employed, applicants will be required to provide the last 3 years accounts together with an accountant’s reference. This list is not exhaustive and the referencing company may request other important HMRC documents or accountant supplied declaration(s) if they deem it necessary.

7. Prior to moving in a deposit equivalent to one month’s rent shall be payable in cleared funds together with the balance of the first month’s rent.

8. If a pet is moving into the property, there may be an additional deposit taken on top of one month’s rent to cover any damages made to the property by the pet. This will be discussed and agreed at the time of first viewing as requested by the landlord/landlady.

9. The second month’s rents together with all subsequent monthly rental payments are usually payable exactly one month after the start date of the tenancy at the discretion of the landlord/landlady.

10. The tenancy agreement is a joint and several liability tenancy and if one or more applicants vacate the property independently then the remaining occupants will be liable for full rental damages and any damages incurred.

11. The tenancy you are applying for is a fixed term. If after the expiry of a fixed term both parties wish to extend the tenancy, a fee of £55 will be payable for renewing or extending the tenancy agreement on each occasion, irrespective of the length of the extended period or the type of agreement.

 

  Holding Deposit Terms and Conditions

  1. The Applicant pays the Holding Deposit to indicate the Applicant’s intention to proceed with renting the Property.  This money will be held to cover the expenses of the Landlord in withdrawing the Property from the market while references are taken up. If the application is successful the Holding Deposit will be deducted from the initial monies payable at the start of the Tenancy. 
  1. Payment of the Holding Deposit does not oblige the Landlord to let the Property or any other premises to the Applicant; nor does it commit the Landlord to grant a tenancy or form an offer of a tenancy to the Applicant. 
  1. No interest will be paid on the Holding Deposit.
  1. If it is necessary to alter the tenancy dates due to any change or delay in the Applicant’s circumstances and the Landlord is prepared to agree to grant a longer time period, it will be necessary to charge an additional Administration Fee of £125 (No VAT) or the equivalent of one week’s rent of the intended property – whichever is more.
  1. If the application is unsuccessful because any person forming the Applicant changes their mind and withdraws; fails to pass the referencing procedure and cannot provide a suitable guarantor; or the commencement date is delayed by the Applicant then up to the total of the Holding Deposit money held by Poly Properties will not be refunded to the Applicant but will be used to cover administrative costs of the Landlord. If the Landlord decides not to proceed for any other reason then Poly Properties will return the Holding Deposit money in full.
  1. If after the termination of the above tenancy you remain at the same property and we negotiate another agreement between you and the Landlord for a fixed period or for the tenancy to continue as a statutory Periodic (Shorthold) Tenancy, Poly Properties’ Administration Fee will be immediately due for payment at a rate of £55 (no VAT). If a holding deposit is returned to the Applicant, the repayment is arranged through our Accounts Department and all refunds are made by cheque or bank transfer.  The Applicant should allow a minimum of seven working days for receipt of this money. Poly Properties do not make refunds in cash.
  1. The Holding Deposit does not fall under the deposit protection schemes of the Housing Act 2004.
  1. The Applicant will be bound by the terms of this Agreement if the Applicant or anyone on behalf of the Applicant pays cleared funds into the Agent’s property management account.
  1. The Agreement is subject to the laws in England and Wales.
